Privacy Policy

1. Who we are

Home Open Times ("HOT") is operated by Vumus Investments Pty Ltd (ABN 26 131 264 858), trading as Home Open Times ("Vumus", "HOT", "we", "us" or "our").

HOT provides a technology platform that helps users discover, save and organise property inspections and enables authorised property owners, real estate agents, agencies and other authorised listers to publish and manage property inspection information.

This Privacy Policy explains how we collect, hold, use and disclose personal information.

Where the Privacy Act 1988 (Cth) and the Australian Privacy Principles ("APPs") apply to us, we handle personal information in accordance with those requirements.

2. Personal information we may collect

Depending on how you use HOT, we may collect:

Account information

Your name, email address, telephone number, account credentials and information required to create and administer your account.

Passwords are not stored in readable form and are protected using industry-standard cryptographic hashing.

If you sign in through Apple, Google or another supported authentication provider, we may receive an identifier and other information you have authorised that provider to share with us.

Google Sign-In and Google user data

When you choose to sign in with Google, we receive the following information from Google (depending on the permissions you grant):

• your Google account unique identifier;
• name;
• email address; and
• profile picture (if you allow it). HOT does not currently store your Google profile picture.

We never receive your Google password.

How we use it. We use this information only to:

• create and manage your HOT account;
• authenticate you when you use the app or website; and
• send important account-related communications.

Who we share it with. We share Google user data only with the service providers that host and operate HOT on our behalf, such as cloud hosting and email delivery, and only as far as they need it to provide HOT to you. We do not:

• sell your Google user data;
• use it for advertising or marketing to third parties;
• share it with unrelated third parties for their own purposes;
• use it to develop, improve or train artificial intelligence or machine-learning models; or
• use any Google APIs to generate AI-generated non-consensual intimate imagery (AI NCII).

How we protect it. Google user data is stored in our database on servers in Australia and is only ever sent over encrypted connections (HTTPS/TLS). Every Google sign-in is verified cryptographically against Google's published keys before it is accepted, and access to the data is limited to the people who need it to operate HOT.

How long we keep it. We keep it for as long as your account is open. When you delete your account — in the app (Profile → Delete account) or on the website at https://prod.homeopentimes.com/delete-account — your Google account identifier is removed and your name and email address are erased straight away, subject to any legal retention requirements and to the backup cycle described in section 8.

HOT's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

Profile and preferences

Profile photographs, notification preferences, saved preferences and other information you choose to add to your account.

Property and listing information

If you create, manage or supply a listing, we may collect information including:

• property address and location;
• photographs, descriptions and property characteristics;
• sale or rental information;
• inspection dates and times;
• contact information;
• agency and agent details;
• licence or registration information where applicable; and
• other information supplied in connection with the property.

Some property information may not itself be personal information.

User activity

We may record information about your interaction with HOT, including properties you view or save, searches, inspection bookings or registrations, enquiries, notification activity and your interactions with listings.

Payment information

We may collect information concerning purchases, listing packages, transactions, invoices and receipts.

Payment card information is processed by our payment provider, such as Stripe. We do not ordinarily receive or store your complete payment card number.

Device, location and technical information

We may collect device information, IP addresses, browser and operating-system information, application logs, security information and usage data.

Where you give permission, HOT may use your device location to display relevant properties, inspections or map information. You can control location permission through your device settings.

3. How we collect information

We may collect information:

• directly from you;
• when you create or use an account;
• when you create, save, enquire about or interact with a listing;
• from agents, agencies, property owners and authorised listers;
• from authorised CRM systems, property management systems, listing feeds, APIs and other connected systems;
• from service providers that support HOT; and
• automatically when you use our app, website or services.

Where listing information is supplied through an agency system, CRM, API or other authorised source, the party supplying that information is responsible for having the authority necessary to provide it to HOT.

4. Why we use personal information

We may collect, hold, use and disclose personal information where reasonably necessary to:

• establish, authenticate and administer accounts;
• operate, maintain and improve HOT;
• display and manage property listings and inspection information;
• enable users to search for and organise inspections;
• facilitate enquiries and communications between users and listers;
• process payments and provide invoices and transaction records;
• provide notifications, inspection reminders, listing updates and alerts requested or reasonably expected by users;
• provide customer support;
• detect and prevent fraud, spam, misuse, security incidents and unlawful activity;
• verify agents, agencies or other listers where appropriate;
• analyse and improve the performance, reliability and usability of HOT;
• comply with legal and regulatory obligations; and
• establish, exercise or defend legal rights.

We do not sell personal information.

We do not provide personal information to unrelated third parties for their own third-party advertising purposes.

5. Information visible to other users

Information intentionally included in a public property listing may be visible to users of HOT and, depending on the listing settings, members of the public.

When you submit an enquiry, inspection request or booking, information necessary to deal with that request may be provided to the relevant agent, agency, owner or authorised lister.

Where a listing has a restricted or undisclosed address, HOT may display only an approximate location until the relevant lister authorises or provides the exact address.

Users should not include sensitive or unnecessary personal information in publicly visible listing content.

6. Service providers and disclosure

We use third parties to help provide HOT. These may include providers of:

• cloud hosting and infrastructure;
• databases and data storage;
• authentication;
• email and messaging;
• SMS services, including Twilio;
• payments, including Stripe;
• mapping and location services;
• analytics, monitoring and security; and
• technical support and development services.

We may disclose information to these providers only to the extent reasonably necessary for them to provide their services to us.

We may also disclose information where required or authorised by law, court order, regulatory requirement or where reasonably necessary to protect our legal rights, users, systems or the public.

7. Overseas disclosure and storage

Some of our technology and service providers may store, process or access information outside Australia.

The countries involved will depend on the providers and infrastructure used by HOT and may include the United States and any other countries identified by our relevant service providers.

Where required by Australian privacy law, we take reasonable steps in relation to overseas disclosures of personal information.

We will update this Privacy Policy if there is a material change to the countries in which personal information is likely to be disclosed and it is practicable to identify those countries.

8. Data retention and account deletion

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, to operate HOT, resolve disputes, prevent fraud and abuse, maintain security and comply with legal, accounting and regulatory obligations.

You may request deletion of your HOT account through the functionality provided in the app or website.

Following deletion, we will take reasonable steps to delete or de-identify personal information that we no longer need and are not legally required or otherwise permitted to retain.

Some information may remain temporarily in secure backups or archives until those backups are overwritten or deleted in accordance with our normal retention processes.

We may retain records where reasonably necessary for legal, security, fraud-prevention, accounting, taxation or dispute-resolution purposes.

9. Access and correction

You may request access to personal information we hold about you and ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading.

Some information can be accessed or changed directly through your HOT account.

For other requests, contact us using the details below. We may need to verify your identity before providing access or making a correction.

Certain exceptions permitted by law may apply.

10. Notifications and communications

You may manage optional notifications and alerts through HOT or your device settings.

We may still send communications reasonably necessary to administer your account or transactions, including security notices, account notices, inspection-related communications, payment confirmations and legal or service notices.

Where required by law, marketing communications will include an appropriate means of opting out.

11. Security

We take reasonable technical and organisational measures designed to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure.

These measures may include encryption in transit, password hashing, access controls, system monitoring and limiting access to people who reasonably require it.

No internet-connected system can be guaranteed to be completely secure.

If an eligible data breach occurs, we will comply with applicable obligations under the Privacy Act 1988 (Cth), including notification requirements under the Notifiable Data Breaches scheme where applicable.

12. Third-party links and services

HOT may contain links to real estate agencies, property portals and other third-party services.

Those organisations operate independently of HOT and may have their own privacy practices and policies. HOT is not responsible for the privacy practices of third-party websites or services that we do not control.

13. Privacy complaints

If you believe we have mishandled your personal information or breached applicable privacy requirements, contact:

Please provide enough information for us to investigate your complaint.

We aim to acknowledge and respond to privacy complaints within a reasonable period, generally within 30 days.

If you are dissatisfied with our response, you may be entitled to lodge a complaint with the Office of the Australian Information Commissioner (OAIC).

14. Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to HOT, our technology, providers or legal obligations.

The current version will be published through HOT or our website. Where a change is material, we may provide additional notice through the app, website or another appropriate communication channel.

Terms of Use

1. About these Terms

These Terms of Use ("Terms") govern your access to and use of Home Open Times ("HOT").

HOT is operated by Vumus Investments Pty Ltd (ABN 26 131 264 858), trading as Home Open Times ("Vumus", "HOT", "we", "us" or "our").

By creating an account, accessing HOT or using our services, you agree to these Terms and our Privacy Policy.

If you do not agree, you must not use HOT.

2. What HOT does

HOT is a technology platform that helps users discover, view, save and organise property inspections and enables authorised listers to publish and manage property and inspection information.

Unless expressly stated otherwise, Vumus Investments Pty Ltd:

• is not the vendor, landlord or owner of properties displayed on HOT;
• does not act as the real estate agent or property manager for properties merely because they appear on HOT;
• does not represent a buyer, tenant, vendor, landlord or listing agent in a property transaction;
• does not negotiate or enter property transactions on behalf of users; and
• is not responsible for the conduct of inspections or the ultimate sale, purchase, lease or management of a property.

Any property transaction is between the relevant parties and their respective agents or representatives.

3. Eligibility and accounts

You must be at least 18 years old to create an account.

You must provide accurate information and keep account information reasonably current.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity occurring through your account, except to the extent that activity results from something for which HOT is legally responsible.

You must notify us promptly if you believe your account has been accessed without authority.

We may require identity, agency, authority or licence verification where reasonably necessary to protect users or the integrity of HOT.

4. Property listings

You may only create or manage a listing if you are the property owner or have sufficient authority to advertise or provide the relevant property information.

Agents and other regulated property professionals are responsible for maintaining any licence, registration or authority required by applicable law.

A person supplying listing information must take reasonable care to ensure that information supplied to HOT is accurate and current, including:

• address;
• price or price information;
• photographs;
• property description;
• property features;
• inspection dates and times;
• contact details; and
• sale or rental status.

Listings may also be supplied or updated through authorised agency systems, CRMs, property management systems, APIs and other data feeds.

The party supplying the listing remains responsible for the accuracy and lawfulness of information it supplies.

5. Listing review

HOT may use automated and manual processes to review listings.

Review or publication by HOT does not mean that HOT has independently verified the ownership, condition, legality, accuracy, completeness, availability or characteristics of a property.

We may refuse, suspend, edit, restrict or remove a listing where we reasonably consider this necessary because:

• it may breach these Terms or applicable law;
• it may be inaccurate, misleading, fraudulent or unauthorised;
• it creates a security or safety risk;
• we receive a legitimate complaint or request concerning it; or
• removal is reasonably necessary to protect HOT, its users or a third party.

6. Inspection information

Inspection dates and times are supplied by listers or connected data sources and can change, be postponed or be cancelled.

Users should check the latest information and, where appropriate, confirm an inspection with the relevant lister before travelling.

HOT does not control the conduct of an inspection and cannot guarantee that an inspection will proceed at the advertised time.

7. Intellectual property and listing content

You retain ownership of content you own and upload to HOT.

By supplying content to HOT, you grant Vumus Investments Pty Ltd a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, display and communicate that content to the extent reasonably necessary to:

• operate HOT;
• display and promote the relevant listing;
• provide HOT services; and
• promote HOT and properties available through HOT.

This licence continues for as long as reasonably necessary to provide the relevant service and manage legitimate archival, legal and backup requirements.

You warrant that you have the rights and permissions reasonably necessary to supply content you upload and to grant this licence.

The HOT platform, software, branding, design, databases and other material created or owned by us remain the property of Vumus Investments Pty Ltd or its licensors.

8. Acceptable use

You must not use HOT to:

• publish false, misleading, fraudulent, discriminatory, defamatory or unlawful material;
• impersonate another person or organisation;
• advertise property without appropriate authority;
• harass, threaten or abuse another person;
• send unsolicited spam;
• unlawfully collect or misuse personal information;
• scrape, harvest, systematically download, reproduce or commercially exploit HOT data without written permission;
• circumvent access controls or security measures;
• gain unauthorised access to accounts, systems or information;
• introduce malware or malicious code;
• interfere with HOT's operation; or
• use HOT for unlawful purposes.

Reasonable use of listing information by consumers for genuine property-search purposes is permitted.

9. Payments

Some HOT services may require payment.

Unless otherwise stated:

• prices are displayed in Australian dollars;
• GST is included where applicable; and
• payments may be processed by a third-party payment provider such as Stripe.

The price and inclusions applicable to a purchase will be displayed before payment.

Where a listing requires both approval and payment, publication may be conditional upon both requirements being satisfied.

Refunds and remedies are provided in accordance with the applicable package terms and the Australian Consumer Law.

Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

10. Third-party services and data

HOT may integrate with or link to third-party services, including real estate agency systems, CRMs, mapping services, payment providers, websites and property portals.

We do not control independent third-party services and are not responsible for their availability, content or conduct.

Information obtained from authorised third-party systems may change without notice.

11. No guarantee of comprehensive coverage

HOT does not represent or guarantee that it contains every property, every listing or every open home or inspection available in a particular suburb, region or market.

Properties and inspection information displayed on HOT depend on listings and data made available to HOT by participating agents, agencies, owners, authorised listers and connected systems.

12. Suspension and termination

We may restrict, suspend or terminate an account or access to particular functionality where we reasonably believe this is necessary to:

• enforce these Terms;
• investigate suspected fraud, unlawful activity or misuse;
• protect HOT, its users or third parties;
• comply with law or a lawful request; or
• respond to a material security risk.

Where reasonably practicable and appropriate, we may give notice and an opportunity to remedy a breach before permanently terminating an account.

You may stop using HOT and delete your account at any time, subject to information we are legally permitted or required to retain.

13. Availability of HOT

We aim to provide a reliable service but do not guarantee that HOT will be continuously available or free from technical faults.

We may modify, maintain, update, suspend or discontinue functionality from time to time.

Nothing in this section limits rights that cannot lawfully be excluded.

14. Liability and Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any right, guarantee, condition, warranty or remedy imposed by the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or other applicable law where doing so would be unlawful.

Subject to those rights, HOT is not responsible for loss caused solely by inaccurate or outdated information supplied by an independent lister or third-party data provider where HOT has not caused or contributed to that inaccuracy.

To the maximum extent permitted by law, HOT is not liable for indirect or consequential loss arising from use of HOT.

Any limitation of liability in these Terms applies only to the extent permitted by law.

15. Changes to HOT and these Terms

We may update these Terms where reasonably necessary to reflect changes to:

• HOT or its functionality;
• our business operations;
• technology or security requirements; or
• applicable laws and regulations.

The latest version will be made available through HOT or our website.

Where a change materially affects users' rights or obligations, we will take reasonable steps to provide notice before or when the change takes effect.

16. Governing law

These Terms are governed by the laws of New South Wales, Australia.

The parties submit to the jurisdiction of the courts of New South Wales and courts entitled to hear appeals from them.

HOT is a technology platform for discovering and organising property inspection information.

Unless expressly stated otherwise, Vumus Investments Pty Ltd is not the selling agent, property manager, vendor, landlord, buyer or tenant in relation to properties displayed on HOT.

Listing information

Property information displayed on HOT may be supplied by property owners, real estate agents, agencies, CRMs, property management systems, APIs and other authorised data sources.

This information may include addresses, prices, photographs, descriptions, floor areas, land sizes, features, sale or rental information and inspection times.

Although HOT may review listings and take reasonable steps to maintain the quality of the platform, HOT does not independently verify every item of listing information and does not guarantee that listing information is accurate, complete or current.

Users should verify important information with the relevant agent, agency, owner or authorised lister.

Not every property or inspection is displayed

HOT does not claim or guarantee that it displays every property for sale or rent, or every open home, private inspection or other property inspection available in any particular location.

The availability of listings depends on information supplied or made available to HOT by participating agents, agencies, owners, authorised listers and connected systems.

Inspection times

Property inspection times may change or be cancelled without notice.

HOT may update information when updated information is received, but cannot guarantee that a listing or inspection time has not changed.

Users should confirm important inspection information with the relevant lister before travelling.

No property, financial or legal advice

Information provided through HOT is general information only.

Nothing on HOT constitutes financial, investment, legal, conveyancing, taxation, valuation, building or other professional advice, and HOT does not make recommendations about whether a user should buy, sell, lease or rent a particular property.

Users should make their own enquiries and obtain appropriate independent professional advice before entering a property transaction.

Property inspections and due diligence

Photographs, descriptions and listing information are not a substitute for inspecting a property and conducting appropriate due diligence.

Depending on the transaction, users should consider obtaining independent advice or reports from appropriately qualified professionals such as solicitors, conveyancers, building inspectors, pest inspectors, surveyors and financial advisers.

Maps, locations and distances

Maps, property markers, suburb boundaries, travel distances and location information displayed through HOT may be approximate.

Where an address is intentionally withheld or restricted, HOT may display an approximate location until the authorised lister makes the address available.

Users should not rely on a map marker as a survey, boundary identification or precise property-location representation.

Third-party websites and services

HOT may provide links to real estate agencies, property portals and other third-party websites or services for convenience.

Those services are operated independently. Vumus Investments Pty Ltd does not control and is not responsible for their content, availability, security or privacy practices.

Consumer rights and liability

Nothing in this Disclaimer excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law.

Subject to those rights and to the maximum extent permitted by law, Vumus Investments Pty Ltd does not accept liability for loss arising solely from reliance on inaccurate, incomplete or outdated information supplied by an independent lister or third-party data source where Vumus Investments Pty Ltd has not caused or contributed to that inaccuracy.
